Constater le retard dans l'exécution de l'obligation et sommer solennellement (exploit d'huissier, lettre recommandée) le débiteur de remplir son engagement. La mise en demeure constitue l'obligé comptable de son retard, ce qui entraîne plusieurs conséquences : du jour de la sommation, il devient redevable des intérêts moratoires, comptable des fruits que la chose a produits, et supporte les risques de perte par force majeure ou cas fortuit.

OBS

En droit civil français et québécois, «demeure» a le sens de «retard juridiquement constaté du débiteur à exécuter l'obligation». Ce terme se rend en anglais par «default». Voir fiche «mise en demeure».
